Terms of Service Agreement

Please read our Terms of Service Agreement before using any of our sites. The terms below were last modified 9/25/2008 and all changes are effective as of 9/26/2008.

1. Descriptions and Definitions

Black Love Interactive LLC warmly welcomes you to our sites and services. By using Black Love Interactive sites and services ("Black Love Interactive", "Service", "Services," or "we") you agree to be bound by all the terms of this agreement (the "User Agreement"). We reserve the right to change the terms of this User Agreement or features of this Service at any time without prior notice to you, and you agree to be bound by any such changes as long as you are using the Service.

These Terms of Service ("TOS") apply to web sites, services, and interactive applications owned or operated by Black Love Interactive and its subsidiaries which include, but are not limited to, BlackLoveInteractive.Com, BlackLove.Biz, SexPlayNetwork.Com, SexGamesNetwork.Com, TVrotica.Com, SexGamesBiz.Com, SexGamesCash.Com, ISERGames.Com, Sex-Ed-Game.Com, CybersexOnlineDating.Com, SexInGames.Net, SexInGames.TV, KinkyOnlineGames.Com, RaptureOnline.Net, ICanHasFreePorn.Com, PlayerPersonals.Com, Gamekkake.Com, Cosplay-Sex.Com, 3DSexPlay.Com, BBWPlay.Com, Couples-Sex-Play.Com, Av-Play.Com, Fetish-Play.Com, Gay-Play-Online.Com, Swingers-Play.Com, FetishPlay.TV, FreePron.TV, MultiverseSex.Com, SLSexPlay.Com, WTFSexTrivia.Com, Porntarded.Com, AdultChatGames.Com, BBWSexGames.Com, BDSMSexGames.Com, CheapAdultGames.Com, SexyChristmasGames.Com, Couples-Sex-Games.Com, Lesbian-Sex-Games.Com, MultiverseSexGames.Com, Queer-Sex-Games.Com, SexGamesNow.Com, SexyStripperGames.Com, Virtual-Sex-World.Com, Erotiseum.Com, KinkyKatClub.Com, Wikirotica.Info, Lesbian-Play.Com, UniformSexPlay.Com, CostumeSexPlay.Com, GothSexPlay.Com, SexPartyPlay.Com, FreeTits.TV, FreeCock.TV, and TVrotica.TV (individually the "Service" and collectively the "Services"). The TOS applies to each visitor and user of the Services, including unregistered and registered users and paying subscribers (individually "User" and collectively the "Users"). Certain additional terms may apply to paying subscribers which are set forth in the appropriate Subscriber Agreement for each Subscription Service. 

2. Service Availability and Performance

Black Love Interactive strives to make your experience enjoyable, however we cannot always anticipate technical or other operational difficulties which may result in loss of data, personalization settings, or other service interruptions. For this reason, you agree that the Services, including the services of our third-party service providers, are provided "AS IS" and "AS AVAILABLE". Black Love Interactive reserves the right, at any time, to modify or discontinue, temporarily or permantently, the Services (or any part thereof) with or without notice to you. You agree that we shall not be liable to you or any third party for any modification, discontinuance, or suspension of the Services. 

3. Acceptable Use and Conduct

By using the Services you state and affirm that you are at least 18 years of age, that the discussion of human sexuality and sexually explicit depictions, in words or images, are not obscene or offensive in any way, that such material could not be considered obscene or offensive to you, and that you do not live in a region where local laws forbid sexually explicit materials. As parents ourselves, we support parental supervision and encourage parents to maintain open communication with their children regarding adult media and online safety. You acknowledge that Black Love Interactive is not responsible for supervising your children, password-protecting your home computer accounts, monitoring or filtering your home Internet access and software usage, or otherwise preventing your children from violating this User Agreement. However, we will do everything in our power to discourage, block, and ban underage users from our adults-only sites, Services, and interactive applications.

Furthermore, you agree not to use the Services for illegal purposes or for the transmission of material that is unlawful, harassing, libelous (e.g., untrue and damaging to others), invasive of another's privacy, abusive, threatening, or that infringes the copyright (e.g., rights of an owner or authorized user of material) or other intellectual property rights of others. You agree to protect your account from misuse and violation of this agreement by protecting the confidentiality of your account password. In the event of any unauthorized use of your password or account or any other breach of security, you must notify Black Love Interactive immediately and promptly change your password. You will be held accountable for actions originating from your account so please choose a strong password and never share it with anyone, even if they request your password or claim to be representatives or employees of Black Love Interactive. No Black Love Interactive employee or representative will ever ask you to reveal your password in plain text format at any time or for any legitimate purpose.

Additionally, there are several practical limits we must place on your use of the Services to help maintain high service stability, availability, and integrity. You agree not to engage in any of the following forbidden uses of the Services: (i) use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, data scrape, copy or transfer any part of the Services or the Registration Data or other data of any User (whether individually or in the aggregate); (ii) probe, scan, or test the vulnerability of the Services, or breach the security or authentication measures on the Services; (iii) reverse look-up, trace or seek to trace any information on any other User of the Services, including any account not owned by you, to its source, or exploit the Services in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information as provided for by the Services; (iv) take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Services; (v) use any device, software, or routine to interfere or attempt to interfere with the proper working or authorized uses of the Services or with any other person's use of the Services; (vi) forge headers or otherwise manipulate identifiers in order to disguise the origin of any message transmittal you send on or through the Services; and (vii) impersonate any other individual or entity or misrepresent your identity or your affiliation with another individual or identity for any malicious or unlawful purpose. 

4. Proprietary Rights and Privacy

This Service (including all original Black Love Interactive content) is protected by copyright as a collective work or compilation under the copyright laws of the United States and other countries, except where otherwise noted (or clearly labeled with a Creative Commons license notice). All individual original content from Black Love Interactive (including, without limitation, text, video, graphics, and audio) are copyright, trademark or servicemark Black Love Interactive LLC as noted on the individual content items. All individual third-party content not originating from Black Love Interactive (including, without limitation, graphics, video, and audio) are protected by the copyright, trademark or servicemark of the respective content owners. All content not originating from Black Love Interactive is either User-Posted Content (defined later in section 4 of this agreement), public domain content , used under Creative Commons license terms, used with permission from affiliate and advertising partners, or used under terms of fair use. By posting content in public forums on the Service (collectively, "User-Posted Content"), a user is granting Black Love Interactive the worldwide, royalty-free, non-exclusive, irrevocable, fully sub-licensable license to use, reproduce, remix, modify, adapt, translate, publicly display, publicly perform, create derivative works from, transfer, transmit and distribute on the Services in connection with promotion or elsewhere, such User-Posted Content (in whole or in part) and to incorporate the User Content into other works in any format or medium now known or later developed. Black Love Interactive will take reasonable precautions to help you to keep your email, private message, voicemail, private chat and interactive play messages, audio, and video private. Please be mindful of the differences between public versus private communication forums when you are Posting to the Services.

Furthermore, you are solely responsible for all User-Posted Content or information of any type or medium that you upload, post, email, transmit, or otherwise make available on or through the Services (collectively, "Post"). "User-Posted Content" includes but is not limited to letters, emails, private messages, other forms of communication, personal information, forum posts, reviews, news tips, notes, testimonials, poll votes, images, audio, video, or software. You may only Post content which you own, have created or which you have clear permission to Post. You acknowledge that Black Love Interactive does not endorse any User-Posted Content and is not responsible or liable for any User-Posted Content, even though it may be unlawful, harassing, libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable, or may infringe upon the intellectual property or other rights of another. You acknowledge that Black Love Interactive does not pre-screen User Content, and has no obligation to do so, but that Black Love Interactive and its designees will have the right (but not the obligation) in their sole discretion to refuse, edit, move, or remove any User-Posted Content that is Posted on or through the Service.

Some of the User-Posted Content you Post to the Services will be private user data which is protected by our Privacy Policy. However, content or communications Posted in public forums on the Services are public, not private, communications and others may read your public communications without your knowledge or consent. You should not have any expectation of privacy relative to your communications in public forums on the Services. Always use caution when posting personal or identifying information on public forums on the Services. Posting personal or identifying information to public forums on the Services is done at your own risk. Black Love Interactive is not responsible for its theft, misuse, copying or placement of your User-Posted Content on other media or networks. Black Love Interactive and its affiliates do not control or endorse the content, messages or information found in any User-Posted Content on our Services and, therefore, we specifically disclaim any liability with regard to the Services and User-Posted Content therein and any actions resulting from your participation or the participation of others using the Services. We respect your private user data and have developed a detailed Black Love Interactive Privacy Policy that is incorporated into this TOS. Please take the time to read the full Privacy Policy. As a User of the Services, you are accepting the terms of our Privacy Policy. 

5. Indemnity

You agree to indemnify and hold harmless Black Love Interactive and its affiliates, and their respective members, directors, officers, managers, employees, shareholders, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation by you of this Agreement. 

6. Disclaimer of Warranties

THIS SERVICE IS AVAILABLE "AS IS."  WE DO NOT WARRANT THAT THIS SERVICE WILL BE UNINTERRUPTED OR WITHOUT ERRORS. THERE MAY BE DELAYS, OMISSIONS, INTERRUPTIONS, AND INACCURACIES IN THE NEWS, INFORMATION, OR OTHER MATERIALS AVAILABLE THROUGH THIS SERVICE. WE DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THIS SERVICE OR ANY INFORMATION OR GOODS THAT ARE AVAILABLE OR ADVERTISED OR SOLD THROUGH THIS SERVICE. WE DO NOT MAKE ANY REPRESENTATIONS, NOR DO WE ENDORSE THE ACCURACY, COMPLETENESS, TIMELINESS OR RELIABILITY OF ANY ADVICE, OPINION, STATEMENT OR OTHER MATERIAL OR DATA DISPLAYED, UPLOADED, OR DISTRIBUTED IN THIS SERVICE. IF YOU RELY ON THIS SERVICE AND ANY MATERIALS AVAILABLE THROUGH THIS SERVICE, YOU DO SO SOLELY AT YOUR OWN RISK. INFORMATION CREATED BY THIRD PARTIES THAT YOU MAY ACCESS ON THE SERVICE OR THROUGH LINKS IS NOT ADOPTED OR ENDORSED BY BLACK LOVE INTERACTIVE AND REMAINS THE RESPONSIBILITY OF SUCH THIRD PARTIES.

A SMALL NUMBER OR USERS MAY EXPERIENCE EPILEPTIC SEIZURES WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS ON A COMPUTER SCREEN OR WHILE USING THE SERVICES. CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WITH NO HISTORY OF SUCH SYMPTOMS. CONSULT YOUR PHYSICIAN PRIOR TO USE OF THE SERVICES IF YOU HAVE HAD ANY OF THESE SYMPTOMS AND DISCONTINUE USE OF THE SERVICES IMMEDIATELY IF YOU EXPERIENCE DIZZINESS, ALTERED VISION, EYE OR MUSCLE TWITCHES, LOSS OF AWARENESS, DISORIENTATION OR INVOLUNTARY MOVEMENTS OR CONVULSIONS. 

7. Limitation of Liability

Black Love Interactive and its affiliates, and their respective members, directors, officers, managers, employees, shareholders, agents and licensors are not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including, without limitation, lost revenues or profits, loss of business or loss of data, in any way related to this Service or for any claim, loss or injury based on errors, omissions, interruptions or other inaccuracies in this Service (including, without limitation, as a result of breach of any warranty or other term of this Agreement). Any claim against us shall be limited to the amount you paid, if any, for use of this Service. 

8. Third Party Services

We are not responsible for the availability or content of other services that may be linked to this Service. You acknowledge and agree that we are not responsible for the availability of such external services, and that we do not endorse and are not responsible or liable for any content, accuracy, quality, advertising, products or other materials on or available from such services. You further acknowledge that Black Love Interactive shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the user of or reliance on any content, goods or services available on or through such services. For your own information and protection, please note the Privacy Policy on all external sites that may be linked to this Service. The Black Love Interactive Privacy Policy will not apply to sites, services, and interactive applications owned and operated by third parties.

 9. Survival and General

This Agreement may be terminated by either party for any reason at any time. Sections 3 through 9 of this Agreement shall survive such termination. Black Love Interactive's rights under the TOS may not be waived unless Black Love Interactive agrees to such change in writing. The failure of Black Love Interactive to exercise or enforce any right or provision of this TOS does not constitute a waiver of such right or provision. If any part of the TOS is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the TOS shall continue in effect.

The TOS, together with any additional terms and conditions or policies referred to and incorporated herein (including additional terms applicable to avarious parts of the Services and the Privacy Policy), constitutes the entire understanding between you and Black Love Interactive and governs your use of the Services, superseding any prior agreements (whether written or oral) between you and Black Love Interactive regarding the subject matter hereof. The TOS and your account on the Services are personal to you and may not be transferred. You may not delegate your duties under this TOS or assign this TOS, in whole or in part. A printed version of the TOS and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the TOS to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. The parties have agreed that the TOS shall be written in English.

Black Love Interactive may assign these Terms of Service to any successor or purchaser of Black Love Interactive, any of its subsidiaries, or all or substantially all of its assets.

This Agreement shall be governed by the laws of the United States and the state of Minnesota, applicable to agreements made and to be performed therein without regard to conflict of laws principles. BY CONTINUING TO USE THIS SERVICE, YOU AGREE TO ABIDE BY THE TERMS OF THIS AGREEMENT.
